The following are general requirements for acquiring a permanent visa
through the Consular Process:
- Admissibility: A foreign national must show that he/she does
not have any undesirable characteristics, which include criminal convictions,
a history of visa fraud or alien smuggling, certain health problems, or a
prior stay in the US in unlawful status of more than 180 days followed by a
departure, and so on.
- Nature of Activities: A foreign national must show that the
activities he/she plans to participate in while in the U.S. are consistent
with the activities permitted by the type of visa for which he/she is
applying.
- Approved Petition: The U.S. Consulate will not issue an
immigrant visa until the USCIS has approved a petition for immigrant status.
(Form I-797C indicating approval of an I-130 (immigrant visa); I-140
(employment-based visa); I-360 (special immigrant visa).
- Current Priority Date: The U.S. Consulate will not issue an
immigrant visa until the foreign national’s approved petition has a priority
date that is current ("ready").
Documents needed for Consular Processing:
- The original I-797 approval notice for immigration
petition;
- One copy of the immigration petition as filed;
- The receipt notice for Form I-824 (only when specifying to
apply for consular processing at first), or the approved notice for Form
I-824 (only if later requesting consular processing);
- Proof that the applicant's last residence was in the host country of the
Consular Post;
- Employment details for the past ten years;
- Medical examination and review;
- Birth certificate, passport, photographs, evidence of financial support,
and tax reporting information;
- Marriage certificates, divorce certificates, or military records, if
applicable;
- Address since the age of 16; and
- Police certificates from all nations where the applicant has lived for
one year since the age of 16.
