H-1B Document Requirement List
(A Brochure for H-1B Visa Petition)
This page is dedicated to letting you know
information/documentation required for the processing of an H-1B Visa
The H-1B Visa Program is commonly used by aliens working in professional and
technical employments in the U.S. This ‘work entry permit’ enables a foreign
worker to stay in the USA for up to 6 years and apply for green card (permanent
residency) in the interim. As part of the H1B processing procedures, the
employer and the beneficiary must make a number of attestations.
Employers are often frightened to sponsor an alien worker because of
misunderstandings about the H-1B petition process and the obligations required
of the sponsor. Immspec.com understands the difficulty an
alien faces when discussing the sponsorship of an H-1B work visa with the
prospective employing company. To facilitate the process, we provide a brief
summary of documentation required to complete H-1B petition, see the outline

Information/Documentation required from foreign worker for the processing of
an H-1B visa:
- Current resume
- Copies of degree certificates and transcripts or mark sheets (USA &
Abroad)
- Reference letters from previous employers, if readily available
- Professional License, if any
- Copies of any professional development course certificates available
- GOOD copy of the front and back of I-94 card (which denotes the type of
non-immigrant visa category). It is important that we must be able to read the
rubber date stamp indicating your date of arrival into the USA.
- Complete copy of passport, exclude blank pages
- Full name (Given Name, Middle Name, Surname), date and place of birth
(city, province, country)
- Current address in USA, plus mailing address if different
- Permanent address abroad (parent's address, if you do not have a residence
abroad)
- Home and work telephone numbers
- USA Social Security number, if you have ever had one
- Copy of I-20 authorizing practical training and GOOD copy of
EAD card
(Make sure the expiration date is readable), if applicable
- Copies of any prior H-1 approval notices or J-1 (IAP-66 forms), if
applicable
- Address that you prefer to receive mail. We will mail to your work address
unless advised otherwise
- USA Consulate/Embassy you would like us to have USCIS send a wire approval
to, if necessary
- If you are currently on H-1B status and are changing employers or need an
extension of stay with the same employer, we must have a copy of your most
recent check stub (one that is less than two weeks old) or a letter from your
current H-1B employer verifying your current employment with them.
- Copy of your education evaluation, if one has already been completed
Information/Documentation required from Employer to complete H-1B Visa
forms:
- Job title
- Detailed job description: To give you an idea of what is required, the
following type of information should be included for computer related
positions: include software, hardware, languages and operating systems for
computer jobs. Other professions should provide us with a detailed job
description using terms specific to their industry. (Example - Design and
development of new client/server database solutions using expertise with
Oracle and Sybase RDBMS, SAP, C/C++ and general software engineering and
development techniques including GUI development on UNIX and Windows
platforms.)
- Salary offered
- The company's minimum requirements for the job (for example, a Bachelors
degree plus 1 year experience)
- Name and job title of person who will sign the forms on behalf of the
company
- Name and address of company. If foreign worker will be working at a client
site, give us the name of the client site company and its physical address.
- Informational brochures/promotional literature about the company. If this
is a new company just starting up we need financial information about the
company such as bank statements, most recent income tax return, articles of
incorporation, business plan, financial statements or any documentation which
will prove that the company is lucrative and can pay the salary of the foreign
worker you want to hire.
- Employer Federal Tax I.D. #, year company was established, approximate
number of employees and approximate gross and net annual income
- Telephone number and fax number for company
- Client site letter on the client site's letterhead. We will be happy to
assist you with language necessary for this letter to be most effective.
Information required on spouse and children, if married:
- Full name, date and place of birth
- Social Security numbers for spouse and children, if applicable
- GOOD copy of the front and back of their I-94 cards
- Complete copy of spouse and children's passports
- If spouse is currently on own F-1, we recommend they remain on
F-1 status
to take advantage of F-1 practical training. If spouse is on their own H-1,
we'd like a copy of the H-1 approval notice in order that we can keep track of
their expiration date
- Marriage certificate with translation, if applicable
- Birth certificates for the children with translations, if applicable
