Introduction:
H1B is an employment-based non-immigrant visa which permits foreign
professionals
to come to the United States and temporarily perform services in a
specialty occupation such as physical sciences, engineering, architecture,
medicine and health, business specialties, education, law, theology, accounting
and the arts. For filing the H1B visa, you need at least a degree from an
accredited institution or you must have 10 years of work experience in fields
related to the work you will be performing in the United States.
The process of H1B visa filing is quite complicated. The filing the work visa
petition must include the required forms, filing fees, documents and
information; form I-129, resume, education & experience evaluation & documents,
training certificates, employment agreement and letter of support. Individuals
cannot file their own h1b visa petition. Filing the H1B visa is tied to the
employer. It means that you need to find a company/a sponsoring employer to hire
you for a position directly related to your degree or work experience.
In general, you have to go through four steps to qualify for H1B work visa -
- The candidate must, first, find a job with a U.S. H-1B visa employer
(called "sponsor").
- The sponsor files H-1B visa application with the US Immigration Bureau.
- The immigration bureau approves the H-1B visa request.
- The applicant is eligible to work in the USA for his/her new employer.

Filing H1B Visa Application:
Basically, there are two ways to file H1b visa application –
It would take 4-6 months for processing the h1b visa petition via regular
processing. If you need a faster processing, then it is better to opt for the
premium processing service. Additional fees are charged if the visa petition is
filed through premium processing. You are permitted to remain in H1b status for
a maximum period of six years. Additional extension may be possible for certain
individuals in the permanent residency process. On the expiry of visa period,
you must remain outside the United States for a period of one year before
another visa petition is approved.
Documentation Required:
- College degrees (Associate, Bachelor, Master, Ph.D.)
- Current resume describing employment history such as name & address of
employer, job title, month/year of commencement of employment & month/year in
which the employment is concluded, type of business, nature of duties
performed etc.
- Reference letters from previous employers.
- Identity page in passport and any pages proving current US visas.
- Evidence of professional license if any.
- Marriage certificate if applicable.
- Birth certificates for the children, if applicable.
