K2 Visa
(Non-immigrant visa for children of K-1 fiance visa holder)
This page describes all about K-2 visa, which is issued to the minor children of a K-1 visa holder.
Definition of K2 Visa:
K2 visa is a non-immigrant visa, which permits the child of a
K-1 visa holder to
enter into the United States and await the availability of an
immigrant visa.
With K-2 visa, the children
of K-1 fiance visa applicant are permitted to
stay in the U.S. for a period of 90 days from the date of initial entry into the
United States. The applicant is not eligible to apply for extension of stay on
K-2 visa. If the parent k-1 visa holder does not marry within 90 days, the child
should leave the U.S. within 30 days.
To qualify for K2 visa, you should be:
- less than 21 years old;
- be an unmarried child of a K-1 visa holder;
- be awaiting to immigrate to the U.S.
The application for K2 visa should be filed at the time of filing K-1 fiance
petition. In order to get K2 visa, normally you have to attend an interview at
the American Consulate. Certain consulates do not require a child of k-1 visa
holder to attend the interview, if he/she is below the age of 14. Some
consulates require a child to attend even if he/she is not going to enter into
the U.S. with K-1 parent immediately, but will follow later.
