TD Visas are temporary visas available to the immediate family
members of TN NAFTA Work Visa holders
Definition of TD Visa:
The TD visa is a temporary US family visa suitable for the spouse and minor
children
of a TN status holder. A TD visa holder can stay in the United States
as long as the principal TN visa holder remains in lawful status. More clearly,
the TD holders lose their status once the principal applicant loses TN status.
They are also allowed to change or adjust their status in the USA.
TN NAFTA Work Visa is a non-immigrant work visa category available only to
citizens of Canada and Mexico. The NAFTA (North American Free Trade Agreement)
authorizes a citizen of a NAFTA country to work in a professional occupation in
another NAFTA country, as long as the applicant meets certain requirements. In
general, a TN visa is available for teachers, scientists, and medical
professionals. The permitted initial stay of a TN status holder is one year and
the status can be extended indefinitely.
TD Visa Employment Regulations:
Under any circumstance, TD status holders are not allowed to earn income in the
U.S. To be precise, a TD holder may not be employed while in the U.S. If the
visa holder wishes to work in the country, he/she must obtain a
work visa that
allows the person to temporarily live and work in the U.S. Aliens who begin
employment without the proper visa are breaking the law and may be expelled.
Studying in the U.S.:
A person on a TD status is permitted to full time or part time study during
his/her stay in the United States.
Documents required to apply for the visa:
A TD applicant must submit the following documents:
- Completed DS-156 Form (nonimmigrant visa application form).
- Form DS-157 (supplemental nonimmigrant visa application form). Submission
of this form is required for all male applicants between the ages of 16 and 45
irrespective of nationality.
- Original valid passport (at least 6 months.)
- Two identical passport-size photographs, with a plain white or off-white
background. The photo must be taken within the past 6 months.
- Older passports containing previous visas.
- Documents substantiating previous legal status in the United States.
- Application fee (non-refundable.)
- Copies of principal TN applicant's documents.
- Proof of dependent's relationship to the principal visa holder. The
documents must be original or certified copy.
